The prosecutor Álvaro Redondo considers that there are "no rational indications of criminality at this procedural moment" for the Supreme Court to open a case against Carles Puigdemont for Tsunami Democràtic. In his report, which this newspaper has accessed, he points out that the magistrate of the National Court, Manuel García-Castellón, "must continue the investigations," but warns that in this case "the criminal type of terrorism does not apply" and rejects his attempt to elevate it to the high court.
As revealed by El Confidencial this Sunday, that is the position Redondo will convey to the rest of the prosecutors of the Supreme Court's Criminal Division during the meeting scheduled for next Tuesday. According to legal sources, the prosecutor even discussed with some colleagues the possibility of initially advocating for opening a case against the former Catalan president, but ultimately his report argues for the opposite decision. This opinion is not binding for the Supreme Court's Criminal Division, which will have to decide whether to follow it or decide to open a case against this argumentation.
"The indications considered by the instructor, in order to raise the reasoned statement, are too broad to assert that the procedural situation allowing the Supreme Court to assume jurisdiction reasonably exists," he argues in his report. "It does not fit into the terrorism type, as this requires the commission of a serious crime against freedom."
